CHAPTER 2 [RELATIONSHIP WITH MARIA PEQUE]
Notwithstanding the infrequent lapses in enforcing social and cultural norms, the religious and civil authorities also kep watch over indigenas who in any way threatened the honor of households. One native woman who faced harsh consequences - banishment - for threatening a gente-de-razon marriage and family was Maria Pequi.
In 1840, Duran wrote to the prefect complaining about "the notorious public scandal caused in [the] community by ... Maria Pequi. 45 Pequi's crime, Duran informed the prefect, was cohabiting with the Irishman "Santiago Bore" (James Burke", who was separated from his wife, Josefa Boronda, "that worthy but unhappy woman." Bishop Garcia, frustrated by Pequi and Burke's continuing relationship, asked for Prefect Arguello's assistance, "Pequi has had the extreme and unheard of impudence of following and enticing Don Santiago, [whether] through the streets, into houses, on corners, and [she has] even gone into his home in plain sight of his legal wife," Duran charged. "Were it not for [Pequi's] evil provocation, it is ... believed that the husband would have desisted from such an immortal life."
Rather than lay any blame on Burke for the extramarital relationship, the bishop condemned Pequi for dishonoring Burke and Boronda's family, which is yet another indication of the sexual double standard that existed not only in the Los Angeles community but also throughout Alta California. her ethnicity as an indigenous woman also reinforced the believe that Pequie had tempted Burke, for members of the community tended to condemn indigenous people of both sexes as initiators of corporal and sexual "excesses."46
To end "the persistent" scandal," preserve "public morals," and achieve the peaceful reunification of "the honorable [Burke and Boronda' familiy," Duran persuaded the governor, who had ultimate say in matters involving indigenous peoples, to banish Pequi from the territory. Burke received no punishment other than a warning that he would be "severely punished" if caught "having the slightest personal communication" with Pequi. In this case, Burke's status as a married man and member of the tente de razon excused him from his responsibility in the liaison, while Pequi, an indigenous woman with little or no social standing, suffered the full consequences of their relations. 47
