Deputy Andrew Kriss was shot and killed by a group of bandits involved in the theft of horses and live stock he had followed toward Mexico.
He and a county constable had gone to a ranch in Rancho de las Viejas to round up the horses after they had been deserted. As the two drove the horses back towards town several Californios ran most of the horses off.
The two lawmen tracked the thieves towards Mexico and overtook two of them who had fallen behind. As they continued towards the rest of the thieves a shootout ensued and Deputy Kriss was shot in the head and killed.
Although they had been identified, the suspects were never apprehended.
Deputy Kriss had served with the San Diego County Sheriff's Department for only a few years. He was survived by his wife and two daughters.

OUR LETTER FROM SAN DIEGO CAL.

SAN DIEGO, CAL., May 30, 1864
Deputy Sheriff Killed.
EDITORS ALTA: --- It appears, from the information that I get, that as Don Jose Sepulveda, of Los Angeles, was moving some horses, etc., down into Lower California, for pasturage, some parties in Los Angeles got out attachments, and had the animals stopped by the Sheriff at Warner's Rancho. Andrew Kriss, one of the Deputy Sheriffs of this county, was left in charge of the horses, with instruction to herd and graze them on the ranch above mentioned, until further orders. On last Tuesday night, a day or two after the attachment had been served and the property taken possession of, some parties, while the Deputy Sheriff was asleep, drove the property off. Among these persons, it is said, was one of Sepulveda's sons, named Andrenico.
When the Sheriff found out, in the morning, what had taken place, he summoned two or three men, and went on in pursuit of the property. About four o'clock he overtook them, or at least overtook young Sepulveda, who it appears, was a long way behind the main party, collecting and driving along the tired-out animals. Some words passed betweeen them in English, which was not understood by those that were with the Deputy Sheriff, they being Spaniards, when the Sheriff pulled out his pistol (a new Colt's revolver) and fired at young Sepulveda, who immediately fired back; another shot was then exchanged, when the pistol of the Sheriff was fouled by a piece of cap, in such a way that it would not revolve. Up to this time neither of the four shots fired had taken effect, although the respective parties were quite close together. While the Sheriff was fixing his pistol, young Sepulveda coolly and quietly rode off some fifty yards to a large tree, which he got behind, as is supposed, for self-protection. After the Sheriff had adjusted his pistol he cocked it and made up to the tree, when Sepulveda shot him. The shot took effect just below the right eye, penetrating in an upward direction, lodging in the brain, killing the Sheriff instantly. This is a very sad affair, and is the first one of the kind that has occurred here for many years. The deceased was a German by birth, and leaves a wife, a mother and two sisters in the old fatherland to mourn his early and untimely demise. He was about 35 years of age, and had resided here some twelve years. Sepulveda, with the balance of the party and property, went on into the lower country, since which time nothing has been heard of them. No arrests have been made, and as there is no extradition treaty with -- a thing, by the way, which we very much need, with Mexico-- there probably will not be.
